From our news partners at Local 3 News: Aubrey Preston, son of Life Care Centers of America founder Forrest L. Preston, has won a petition to become his father’s temporary emergency conservator.
Chancery Court Chancellor Jerri Bryant sided with Aubrey Preston during a hearing yesterday, ruling that Aubrey will become Forrest’s conservator for a 60-day period. She noted that her ruling was “not a determination” of Forrest’s “incapacity,” which will be reviewed starting on Jan. 13, when the court will hear arguments for making Aubrey his father’s permanent conservator.
As his father’s emergency conservator, Aubrey will gain the power to make key decisions about Life Care. However, Bryant stipulated that these must be decisions that “cannot wait” until Jan. 13 and must be agreed upon by Life Care President Todd Fletcher and CFO Steve Ziegler. Bryant gave Aubrey has power over Forrest’s passport and medical care, as well as the right to visit his father daily without Kim present. Forrest’s other two children and grandchildren can also visit him weekly.
Aubrey was denied his request to begin investigating cash and real estate transfers from Forrest to Kim and her family members, which the chancellor said will be on hold until the January hearing.
Neither Forrest nor Kim were present at the Wednesday hearing. However, their attorneys have denied claims that Forrest is not being taken care of.
Aubrey alleges Forrest is suffering from dementia and is being abused and exploited by his wife, Kim Preston.
